Agreement Not to Sue. You agree that you will not at any time maintain or file any lawsuit or assert any claim against any Symetra Releasee for any damage or loss related in any way to your employment or association with Symetra, except a claim to enforce this Agreement or a charge with the EEOC as identified above.
Agreement Not to Sue. I agree never, at any time now or in the future, to institute any lawsuit or cause of action against Skydive Dubai or anyone else claiming on my behalf, or initiate or to assist in the prosecution of any claim for damages in respect of injury to person or property, or my death, or any other loss or damage, howsoever occasioned arising from the said activities, whether caused by the act, omission, negligence or fault, active or passive, direct or indirect or from any other cause.
Agreement Not to Sue. I agree I will not sue Avalanche Express/Meadville Pines, Inc., its employees, agents or owners, and hereby release the same from any and all liability of Avalanche Express/Meadville Pines, Inc., and any related party, and employee of the aforementioned company and all other persons, firms, corporations, and other entities, their heirs, assigns, successors or successors-in-interest, resulting for any reason, or any cause, to injury to myself or any member of my family, including injuries caused due to passive and/or active negligence, the design of the facilities and all matters herein mentioned.
Agreement Not to Sue. Employee agrees not to sue the Company in any court with respect to any of the claims released in this Agreement except as specifically permitted in this paragraph below. If Employee, or anyone on Employee’s behalf, breaks this promise, then Employee shall be required to repay the Settlement Payment except for $200; alternatively, at the Company’s option, Employee shall be liable for the payment of all costs and attorneys’ fees paid by the Company in connection with such a lawsuit. This Agreement not to sue does not prohibit Employee from bringing a lawsuit to challenge the enforceability of this Agreement as it relates to age discrimination claims. Employee will not be required to repay the Settlement Payment in order to challenge the validity or enforceability of this Agreement under the Age Discrimination in Employment Act, and will not be liable for the payment of costs and fees paid by the Company in connection with such a challenge. This does not mean that Employee retains the right to obtain relief for age discrimination after signing this Agreement. After signing this Agreement, Employee may obtain relief for age discrimination only if Employee obtains a court order stating that this Agreement is not enforceable.
Agreement Not to Sue. Xxxxxx agrees never to sue, institute, cause to institute, assist any other person or entity in instituting or permit to be instituted any legal or administrative proceeding relating to or arising out of any claim and/or cause of action released in paragraph 3 above. Xxxxxx further agrees that if he files or causes to be filed any claim or cause of action which is found to be barred in whole or in part by this Agreement, he will pay all attorneys' fees and costs incurred by the defending party, its present and former officers, directors, employees, agents and attorneys, in defending against those barred claims.
Agreement Not to Sue. Xxployee promises never to file a lawsuit asserting any claims that are released in paragraph 5 above.
Agreement Not to Sue. Contractor agrees that it will not sue the City for damages in connection with the disclosure by the City of information that Contractor asserts is exempt from disclosure, so long as such disclosure was inadvertent and the City uses reasonable efforts to mitigate the effects of the inadvertent disclosure and/or uses reasonable efforts to retrieve the information as appropriate.

Agreement Not to Sue. Executive agrees that he shall neither file nor instigate the fixxxg of any suit, claim, or charge based upon or related to his employment against AMCORE, its officers, employees, or agents, with any federal, state, or local court or administrative agency, body, or tribunal. This provision shall not apply to any claims that are not waived under Section 2.1 above.
Agreement Not to Sue. 6.1 Each party agrees, on behalf of itself and on behalf of its Related Parties not to sue, commence, voluntarily aid in any way, prosecute or cause to be commenced or prosecuted against the other party or its Related Parties any action, suit or other proceeding concerning the Released Claims, in this jurisdiction or any other.
