Prudent Industry Standards definition

Prudent Industry Standards means the practices, methods, equipment, specifications and standards of safety, as the same may change from time to time, as are used or approved by a significant portion of the residential rooftop distributed solar electric generation industry operating in the applicable Project States in residential rooftop distributed solar electric generating systems or facilities of a type and size similar to the Projects as good, safe and prudent engineering practices in connection with the design, construction, operation, maintenance, repair and use of electrical and other equipment, facilities and improvements of such residential rooftop distributed solar electric generating system or facility, with commensurate standards of safety, performance, dependability, efficiency and economy, in each case in light of the facts known and circumstances existing at the time any decision is made or action is taken, that would be expected to accomplish the desired result in a manner materially consistent with Applicable Law, Permits, codes, and equipment manufacturer’s recommendations.
Prudent Industry Standards means the practices, methods, acts and equipment (including but not limited to the practices, methods, acts and equipment engaged in or approved by a significant portion of the renewable energy electric generation industry operating in the United States in prudent electrical operations) that, at a particular time, in the exercise of reasonable judgment in light of the facts known or that reasonably should have been known at the time a decision was made, would reasonably have been expected to accomplish the desired result in a manner consistent with (i) Applicable Law (including, for the avoidance of doubt all consumer protection laws) and permits, (ii) codes, standards and equipment manufacturer’s recommendations, in each case, customarily followed in the residential solar power industry and (iii) such regard to reliability, safety, environmental protection, efficiency, economy, and expedition as is customary in the residential solar power industry.

More Definitions of Prudent Industry Standards

Prudent Industry Standards means, with respect to Contractor’s performance of its obligations under this Agreement, at a particular time, in the exercise of reasonable judgment in light of the facts known, or that should have been known, at the time a decision was made, those practices, standards, designs, methods, means, techniques, equipment and acts that would require a Person to: (a) perform its duties in good faith and as a reasonably prudent contractor and in compliance with applicable Law and applicable Permits, (b) perform its duties in compliance with the requirements of the Solar Lease, the Interconnection Agreement and the Power Purchase Agreement in all material respects, (c) perform its duties in compliance with Good Utility Practices, (d) exercise such care, skill and diligence as a reasonably prudent business company of established reputation engaged in the solar energy business would exercise in the conduct of its business and for the advancement or protection of its own interests, (e) perform the duties in accordance with applicable United States solar energy industry standards, taking into account the requirements to qualify for the ITC under Section 48 of the Internal Revenue Code, (f) use sufficient and properly trained and skilled personnel, and (g) use parts and supplies that meet the specifications set forth in the Solar Lease, the Interconnection Agreement and the Power Purchase Agreement. Prudent Industry Standards are not intended to be the optimum practice, method or acts to the exclusion of all others, but rather are intended to be any of the practices, methods or actions generally accepted in the United States that meet the foregoing standards.
Prudent Industry Standards means project management practices that shall likewise be performed in accordance with generally accepted national standards of professional care, skill, diligence and competence applicable to utility scale
Prudent Industry Standards means those practices, methods, equipment specifications and standards of safety and performance, as the same may change from time to time, as are commonly used in facilities in the United States of a type and size similar to the facility in question.
Prudent Industry Standards means those standards of care and diligence normally practiced by water transportation infrastructure operation and maintenance firms in performing services of a similar nature in a similar jurisdiction in which the Water Transportation Services and Operational Work will be performed. Prudent Industry Standards means those standards of care and diligence normally practiced by firms engaged in performing the Work under the same or similar circumstances as those contemplated in this Agreement and any Work Authorization at the time such activities were performed, and as are in accordance with generally accepted national standards of professional care, skill, diligence and competence applicable to engineering, construction and project management practices, and with similar access to information, documents and pre-construction site inspection, and in accordance with good engineering design practices, applicable approvals from any Governmental Authority, Applicable Laws, and other standards established for such work, including using environmental best practices and standards. Prudent Industry Standards are not intended to be limited to the optimum practices, methods or acts to the exclusion of all others, but rather to be a spectrum of good and proper practices, methods and acts.
Prudent Industry Standards means the generally accepted practices, methods, techniques and standards employed by the highway management and development industry in accordance with Applicable Law with respect to: (a) the development, operation and maintenance of highways; (b) personnel and highway safety and environmental protection; and (c) optimizing the performance of the Operations.
