The performance bond shall remain in force and effect throughout the Term of this Franchise Agreement.
No provision of this Franchise Agreement shall be amended or otherwise modified, in whole or in part, except by an instrument, in writing, duly executed by the Franchise Authority and the Franchisee, which amendment shall be authorized on behalf of the Franchise Authority through the adoption of an appropriate resolution or order by the Franchise Authority, as required by applicable law.
The term of the Franchise granted hereunder shall be twelve (12) years, commencing upon the Effective Date of the Franchise, unless the Franchise is renewed or is lawfully terminated in accordance with the terms of this Franchise Agreement, the Code of Virginia, and the Cable Act.
In compliance with the surety requirements of the Town Code, within sixty (60) days of the Effective Date of this Agreement, Franchisee shall post a performance bond in the amount of fifty thousand dollars ($50,000) for the faithful performance and discharge by Franchisee of all obligations imposed by this Franchise Agreement.
Any agreements, ordinances, representations, promises or understandings or parts of such measures that are in conflict with or otherwise impose obligations different from the provisions of this Franchise Agreement are superseded by this Franchise Agreement.
