Excluded Facilities definition

Excluded Facilities. As defined in Section 11.5.4.

Excluded Facilities means all casino facilities, as defined in section 3772.01 of the Revised Code; all video lottery terminal facilities, as authorized in section 3770.21 of the Revised Code; and all sports gaming facilities, as defined in section 3775.01 of the Revised Code.

Excluded Facilities means the plants, offices, and manufacturing, processing, distribution, storage, warehousing and other facilities identified on Schedule 2.02(i).

• In the event Delphi agrees to do so, the applicable definitions of Acquired Assets, and/or Real Property will be amended as set forth in such notice to remove the additional excluded assets or real property and the definition of Excluded Assets and/or Excluded Facilities, if applicable, may be amended as provided in such notice to include such additional excluded assets or real property or Manufacturing Facilities.

• Wage escrow accounts applicable to non-Transferred Hourly Employees at the sites included in the Excluded Facilities.

• Equitrans will comply with all FERC regulations and requirements necessary to construct and operate the Sunrise Facilities (including any Additional Facilities) and any Excluded Facilities.

• Lessee shall remit to SBILP or its nominee, promptly following the execution and delivery of this Lease, all funds remaining, if any, after payment of all accrued Gross Operating Expenses (as such term is defined in the Original Lease) with respect to the Excluded Facilities for the period prior to the Commencement Date, and other amounts due Lessee with respect to the Excluded Facilities for the period prior to the Commencement Date.

• All Real Property (including any improvements located thereon) listed in Schedule 2.1.5.F (the “Excluded Facilities”) and personal property and other assets located at the Excluded Facilities.
