California Participant definition

California Participant means a Participant whose Award is issued in reliance on Section 25102(o) of the California Corporations Code.

California Participant means a Participant whose Award, when granted, was issued in reliance either on section 25111, 25112 or 25113 of the California Corporations Code. Solely to the extent required to comply with the requirements of the California Corporate Securities Law of 1968 at the time of grant and thereafter, Awards to California Participants shall also be subject to the additional terms specified in Appendix A. The Committee, in its discretion, may also elect to include some or all of the Appendix A terms in Awards to Participants who are not California Participants. Appendix A is a part of this Plan.

California Participant means a U.S. Participant who is a resident of the State of California.

Examples of California Participant in a sentence

• If relocation occurs outside of California, Participant shall repay the NSAQMD based on the repayment equation specified in Paragraph 4 (“Performance”) of this Agreement.

• If for any reason during the life of this Agreement the Participant wants to relocate outside of Nevada, Sierra or Plumas counties and continue to use the new engine(s)/equipment inside California, Participant shall notify the NSAQMD of the specifics of the relocation in writing 15 days prior to the relocation and begin working with the NSAQMD to determine the possibility of modifying the Grant Agreement.

• You are a California Participant if you provided a California address in your application, if you are a resident of California at the time you or we demand arbitration or initiate any proceeding in court regarding a Dispute, or if California law governs your Dispute.

• If you are a California Participant, or your arbitration hearing will take place in California, you will not be required to reimburse us for money we advanced for you in arbitration even if you lose the arbitration.

• This clause 14 shall not operate to prevent a UK or California Participant from starting legal proceedings in his or her local court.

More Definitions of California Participant

California Participant means a Participant who is a resident of California at the time that an Award is made hereunder.
