Reinstatement Roster. Upon reduction in force, nurses will be placed on a reinstatement roster for a period of twelve (12) months from date of the commencement of the reduction-in-force. Such nurses shall not accrue seniority while on reduction-in-force status but shall retain seniority and accrued unused benefits to the date of the commencement of the reduction-in-force.

Reinstatement Roster. Employees who elect to be placed on the reinstatement roster in accordance with this will remain on the reinstatement roster for twelve (12) months. If the employee’s original position in a department is reinstated while the employee is on the reinstatement roster, the displaced employee on the reinstatement roster will be notified in writing by postage mail and will have first preference in reclaiming the position. Otherwise, employees will be responsible for monitoring the list of open positions. Employees on the reinstatement roster may apply for any open position that becomes available. Such employees will have preference over other applicants, but will compete among themselves for open positions based on overall qualifications for the position in accordance with this Agreement. Notwithstanding the foregoing, transfer within a department will have preference over a recalled employee unless the recalled employee is from the applicable unit and is more senior. If an employee applies for and is offered an open position in the employee’s department when laid off, he/she must accept it or he/she will be deemed to have resigned. To be considered, application must be made within the applicable posting period in accordance with this Agreement.

A nurse shall not accrue seniority or benefits while on layoff status, but shall retain seniority and accrued, unused benefits to the date of commencement of the layoff. Nurses on layoff shall be responsible for maintaining current addresses and telephone numbers with the Employer.‌

Reinstatement Roster. The names of employees laid off shall be placed on a reinstatement roster for a period of one year from the date of layoff. An employee shall be removed from the roster upon reemployment, upon refusal to accept regular and substantially equivalent work offered by the Hospital, or at the end of the one-year period. Substantially equivalent employment means work with comparable pay, benefits, hours of work (FTE and shift) and job duties. An employee on the reinstatement roster shall be eligible for per diem work and shall retain seniority while working as a per diem employee. Acceptance of per diem work while on layoff shall not affect the employee’s placement on the reinstatement roster.
Reinstatement Roster. The names of affected nurses will be placed on a reinstatement roster for a period of up to twelve (12) months after layoff or restructure. A nurse shall be removed from the roster upon accepting employment in a position with the same shift and status, upon refusal to accept a position with the same shift and status, or at the end of the twelve (12) month period. When a vacancy is to be filled from the reinstatement roster, the order of reinstatement will be in reverse order of layoff or restructure change, providing skill, ability, experience, competence or qualifications are not overriding factors as determined by the Employer on the basis of relevant criteria. Subject to the above qualification, nurses on the reinstatement roster will be offered reinstatement prior to any nurses being newly hired and prior to increasing scheduled hours of nurses not on the roster. Upon reinstatement from the roster, the nurse shall have all previously accrued benefits and seniority restored, subject to benefit plan eligibility requirements. A nurse who is laid off will have the option at the time of layoff to receive accrued but unused paid time off (PTO) and may continue group insurance coverage at the nurse’s expense, subject to insurance plan eligibility requirements.

Reinstatement Roster. In the event of a reassignment/layoff, the names of nurses who did not retain a comparable position within the Clinical Group will be placed on the reinstatement roster for a period of one (1) year from the date of reassignment/layoff. A nurse who has been placed on the reinstatement roster will be removed only when he/she accepts or refuses to accept a comparable position within his/her Clinical Group. For nurses on the reinstatement roster who were scheduled to work three (3) twelve (12) hour shifts per week prior to the layoff/reassignment, a comparable eight (8) hour position would have to allow the nurse the option of either working seventy- two (72) hours per pay period as a part-time nurse or eighty (80) hours per pay period to maintain the nurse's full-time status. If a nurse, because of layoff or reassignment, takes a supplemental position on his/her unit or takes a position on another unit, and if such nurse applies for a vacant position on their original unit, the nurse will have the same status as a core unit nurse for all openings on that unit for a period of one year over all non-unit applicants.

If an employee applies for and is offered an open position, s/he must accept it or s/he will be deemed to have resigned and will no longer be on the reinstatement roster. To be considered, application must be made within the applicable posting period in accordance with any other applicable provisions of this Agreement.
