Non-Bargaining Unit Positions. Employees who return to the Bargaining Unit after having served in a supervisory/administrative capacity, shall retain all previously accumulated seniority as a member of the Bargaining Unit. No seniority shall accrue while serving as a supervisor/administrator.

The Hospital agrees to provide notice of opportunities for advance of Nurses into management and supervisory positions at the Hospital and, where possible, will post notice of a vacancy in such a position on the designated Hospital bulletin boards for seven (7) calendar days prior to filling the vacancy. A Nurse desiring to be considered for such a position must make application therefore to the Vice President, Patient Care Services, or her designee. Nothing herein shall be construed as subjecting the Hospital’s exercise of discretion in filling such positions to the provisions of this Agreement.

If the Sheriff determines to return him to a bargaining unit position, he shall be credited with his former seniority that accumulated while inside the bargaining unit.

However, should a bargaining unit employee apply for and not get a position outside the bargaining unit, such a situation is not grievable under any provision of this Contract.

Any person employed in a non-bargaining unit position in the South Kingstown School Department who was employed as a teacher in the bargaining unit at the time of his/her appointment to a non-bargaining unit position shall have bargaining unit seniority for the period of his/her employment as a teacher in the bargaining unit, but shall not accrue any seniority while in a non-bargaining unit position.
