Examples of Unavoidable Delay in a sentence
Pursuant to the terms and conditions contained in the Agreement, if all of the conditions precedent under Section 2.6.1. have not been satisfied, waived or DCAPDX\5114877.v1 otherwise resolved pursuant to this Agreement within three (3) years following the Effective Date, then the Agreement shall automatically terminate on that date (“Final Termination Date”) unless extended by agreement of the Parties prior to the Final Termination Date or due to an Unavoidable Delay.
Subject to the terms and conditions of this Agreement, after Closing, Developer will use commercially reasonable efforts to complete the Project in general conformance with the Final Construction Drawings, and in compliance with the Schedule of Performance, subject to Unavoidable Delay as provided in Section 8.2.
