The Town shall maintain in full force throughout the duration of this Agreement comprehensive general liability insurance with a minimum coverage of $1,000,000 per occurrence/aggregate for personal injury and property damage.
Should a court of competent jurisdiction determine this Agreement is subject to RCW 4.24.115, then in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Town and the Port, their respective officials, officers, agents, or employees, either party's liability hereunder shall be only to the extent of that party's own negligence.
When either agency desires the other agency to perform a service, the requesting agency shall make a written request to the other agency through the Town Administrator or the Port’s Executive Director, or their respective designees.
Nothing in this Agreement shall make any employee of the Town an employee of the Port, and vice versa, for any purpose, including, but not limited to withholding of taxes, payment of benefits, insurance, worker’s compensation pursuant to Title 51 RCW, or any other rights or privileges accorded to either agency’s employee by virtue of their employment.
