Settlement Effective Date definition

Settlement Effective Date means the date on which the Final Order is Final, provided that by such date the Settlement has not been terminated in accordance with Article 11.

Settlement Effective Date means the date on which the last of all of the following have occurred:

Settlement Effective Date has the meaning set forth in Recital D. “Settlement Interval” has meaning set forth in the CAISO Tariff. “Settling Parties” has the meaning set forth in Recital B. “SGIA” (i.e., Small Generator Interconnection Agreement) means the form of Interconnection Request (as defined in the CAISO Tariff) pertaining to a Small Generating Facility (as defined in the CAISO Tariff), which is attached to the CAISO Tariff as Appendix T.

• The Court shall have certified the Settlement Class for settlement purposes only (and Defendants will not object to this certification for settlement purposes only), the Settlement shall have been approved by the Court, the Court shall have entered the Final Order substantially in the form attached as Exhibit D hereto, and the Settlement Effective Date shall have occurred.

• Upon the Settlement Effective Date, and after the amounts payable pursuant to Sections 5.1 and 5.2 have been disbursed, or, in the case of future estimated expenses set aside and withheld, Class Counsel shall direct the Escrow Agent to disburse the Net Settlement Amount as provided by this Settlement Agreement and the Plan of Allocation.

• All such covenants, representations, and warranties set forth in this Settlement Agreement shall be deemed continuing and shall survive the Settlement Effective Date.

More Definitions of Settlement Effective Date

Settlement Effective Date means the date this Settlement Agreement becomes effective in accordance with Section 3.3 of the Settlement Agreement.
