Product Improvement definition

Product Improvement means any improvement made [***].
Product Improvement means any and all Inventions, and any and all changes, modifications and amendments, by or on behalf of a Party, or by the Parties jointly, during the Term, that relate to the Licensed Product, or a modified form thereof, whether patentable or not, whether in the Field or not.
Product Improvement means any enhancement to the Compound in combination with the Commercial Carrier, ingredients, preparation, presentation, dosage, packaging of, manufacture or any new or expanded therapeutic indication for the Product.

Product Improvement means any Program Technology related to or concerning the Product and/or Licensed Technology, whether or not patentable, copyrightable or otherwise protectable under any intellectual property rights.

Product Improvements shall not include any composition of matter or article of manufacture which contains or is made or manufactured using any Excluded Technology.
Product Improvement means any improvement or change, irrespective of whence derived, relating in whole or in part to the composition, formulation or use of a Product or the Technology, including any improvement, development or change relating to a Product by process (I.E., any change in the processing of a Product which yields a materially different Product), such as a change in chemical composition, change in physical characteristics or properties brought about by substitution or replacement of elements or components, change in method of formulation, change in rheology, etc. The term "Product Improvement" shall not include improvements to the physical shape, ornamental design, or configuration of Products (hereinafter "Design Improvements").
Product Improvement means any Improvement directly concerning BEMA, any Licensed Product, or the use or manufacture of either of the foregoing that is invented, conceived, or developed by or on behalf of Purdue, any of its Affiliates, or any of its or their employees, agents, or other representatives, whether alone or jointly with BDSI, any Affiliate thereof, or any Third Party or any of its or their employees, agents, or other representatives, as a result of the exercise of the rights granted to Purdue with respect to any Licensed Product hereunder or as a result of their access to, or use or knowledge of, BDSI’s Confidential Information, BEMA, or Licensed Products.
Product Improvement means any Improvement under this Agreement that (i) constitutes an improvement or new use of API or Product, including, but not limited to: (i) new formulations of API or Product; or (ii) improvements or new methods in the manufacture of API or Product.
