Aggrieved Employees assume full responsibility and liability for any taxes owed on their Individual PAGA Payment.
Seventy-five percent (75%) of the PAGA Payment ($11,250) shall be paid to the LWDA, and twenty-five percent (25%) of the PAGA Payment ($3,750) of the PAGA Payment shall be distributed to Eligible Aggrieved Employees, on a pro rata basis, as set forth below.
The PAGA Payment consists of $15,000 of the Gross Settlement Amount allocated for the settlement and release of claims for civil penalties under the PAGA.
Eligible Aggrieved Employees’ Individual Settlement Shares, from the Eligible Aggrieved Employees’ portion of the PAGA Payment, will be allocated as one hundred percent (100%) penalties and shall be reported by IRS 1099 forms.
At the earliest practicable time following the expiration of the Response Deadline, Class Counsel will file motions and memorandums in support thereof for Final Approval of the Settlement and the following payments in accord with the terms of the Settlement: (i) Attorney Fee Award; (ii) Cost Award; (iii) Administration Costs; (iv) Class Representative Enhancement Payment; and (v) PAGA Payment.
