Non-Performance definition

Non-Performance. ’ shall mean default on a contract in the public/ government sector by willfully or negligently:
Non-Performance means and includes without limitation, Customer complaints, Goods or Services which do not conform to the Agreement, inferior quality of work carried out or materials supplied by the Supplier.
Non-Performance means the failure to meet the complete terms and conditions of this Contract including, but not limited to, the response time. In the event of such cancellation, the County retains the right to claim damages as a result of such default.
