Simpragma reserves the right to temporarily suspend access to the Services: a) during planned downtimes for upgrades and maintenance (reasonable notice of such downtimes will be provided to Customer); b) during any unavailability beyond our reasonable control such as acts of God, acts of terror or civil unrest; c) during technical failures beyond our control such as inability to access the internet or denial of service attacks; or d) if Simpragma suspects or detects Malicious Software.
Further to Clause 16.3 of the Call-Off Contract, Buyer acknowledges that it shall be liable to pay additional Charges in accordance with the rate card included in Supplier's Price List in relation to any remedial action required by Supplier as a result of Malicious Software introduced into the Service Data as a result of the acts or omissions of the Buyer.
