In a third instance, in the event that the Parties fail to achieve an amicable settlement within fifteen (15) Business Days or within any other agreed timeframe between the Par- ties as of the receipt of the request for amicable dispute resolution described above, the most diligent Party shall submit the dispute to mediation by an external independent duly certified mediator under the ICC mediation rules.
Each invoice shall include the AAR/DOT number, the ICC Order number and the state job number when federal funds are involved.
PA shall also provide, in a timely manner, such reports as the ICC or its staff may reasonably require from time to time.
If any nominated arbitrator is not confirmed by the ICC, the party or persons that appointed such arbitrator shall promptly nominate a replacement arbitrator for confirmation by the ICC.
