Any Hazardous Materials in the Premises, and all containers therefor, shall be used, kept, stored and disposed of in conformity with all applicable laws, ordinances, codes, rules, regulations and orders of governmental authorities.
Notwithstanding the foregoing, Tenant shall have no responsibility for any Hazardous Materials existing at the Premises as of the Term Commencement Date and Landlord shall indemnify, defend and hold harmless Tenant from and against any claims, suits, causes of action, costs and fees, including attorneys’ fees arising from or connected with any such contamination, claim of contamination, loss or damage.
The terms of this Section shall apply to any transportation, storage, use or disposal of Hazardous Materials irrespective of whether Tenant has obtained Landlord’s consent therefor but nothing in this Lease shall limit or otherwise modify the requirement of obtaining Landlord’s prior consent as set forth herein.
