NUSD, in consultation with the Athletic Trainer, shall be responsible for ensuring that the room is suitable for use by the Athletic Trainer in carrying out his or her duties under this MOU.
This Term is intended to encompass three academic school years (approximately August to June) with additional time at the beginning of the Term to allow DEVCO to hire the Athletic Trainer and otherwise make all necessary preparations to provide the Services at the commencement of the first academic school year in August 2022.
The Athletic Trainer shall assist and advise the school’s Athletic Director in ordering equipment and supplies, however, the ultimate responsibility for obtaining the supplies and equipment shall rest with NUSD.
DEVCO shall, at its sole cost and expense, procure, keep and maintain, throughout the Term of this MOU, professional liability insurance coverage on DEVCO and each Athletic Trainer performing Services hereunder in at least the minimum amounts required by law.
Notwithstanding the foregoing, in the event the Athletic Trainer terminates his or her relationship with DEVCO in the middle of a School Year, and where such termination is beyond the control of DEVCO (e.g., the trainer takes maternity leave, becomes sick or disabled), DEVCO agrees that it will use commercially reasonable efforts to secure a replacement.
