RIGHTS OF. (a) Within the meaning of The and Insurance Act, the parties agree that every employee who suffers injury by accident arising out of and in the course of employment shall be reinstated. upon being declared able to work, to the position or equivalent position that held on the date of injury, provided that the employee is capable of performing the work available. The Employer agrees to modify the job if necessary to accommodate the employee's disability acquired as a result of said injury, whether temporary or permanent, consistent with the provisions of Community Living Kingston's Early and Safe To Work policy.
