Common use of Pursuant to the Financial Clause in Contracts

Pursuant to the Financial. Administration Act (Ontario), any payment due by Ontario under this Agreement is subject to an appropriation by the Ontario Legislature. Ontario may reduce or terminate any contribution to a Project in response to the reduction of appropriation or ministerial funding levels in respect of transfer payments, the program under which this Agreement was made or otherwise. Notwithstanding Section 23 (Limitation of Liability and Indemnification) of this Agreement, Ontario will not be liable for any direct, indirect, consequential, exemplary or punitive damages, regardless of the form of action, whether in contract or in tort or otherwise, arising from Ontario or Canada’s reduction or termination of funding.
