Common use of Possession of the Premises Clause in Contracts

Possession of the Premises. Upon the occurrence and during the continuance of any Event of Default hereunder, it is agreed that the Mortgagor, if it is the occupant of the Premises or any part thereof, shall upon receipt of written notice from Mortgagee, immediately surrender possession of the Premises so occupied to the Mortgagee, and if the Mortgagor is permitted to remain in possession, the possession shall be as a tenant of the Mortgagee and, on demand, the Mortgagor shall pay to the Mortgagee monthly, in advance, a reasonable rental for the space so occupied and in default thereof the Mortgagor may be dispossessed by the usual summary proceedings. The covenants herein contained may be enforced by a receiver of the Premises or any part thereof. Nothing in this Section 3.04 shall be deemed to be a waiver of the provisions of this Mortgage prohibiting the sale or other disposition of the Premises without the Mortgagee's prior written consent.

Possession of the Premises. Possession of the Premises during the existence of the Indebtedness by the Grantor, or any person claiming under the Grantor, shall be that of a tenant under the Grantee and its successors and assigns. Upon the occurrence and during the continuance continuation of any Event of Default hereunder, it is agreed that the Mortgagor, if it is the occupant of the Premises or any part thereof, shall upon receipt of written notice from Mortgageeshall, at the Grantee’s option, immediately surrender possession of the Premises so occupied to the MortgageeGrantee, and if such occupant is permitted, by the Mortgagor is permitted Grantee, to remain in possession, the possession shall be as a tenant of the Mortgagee Grantee and, on demand, the Mortgagor such occupant (a) shall pay to the Mortgagee Grantee monthly, in advance, a reasonable rental for the space so occupied occupied, and (b) in default thereof the Mortgagor may be dispossessed by the usual summary proceedings. Nothing in this Section 3.04 2.04 shall be deemed to be a waiver of the provisions of this Mortgage Deed prohibiting the sale or other disposition of the Premises Collateral without the Mortgagee's prior written Grantee’s consent.
