Operating Manual. City’s “FY 2011 Update of the Operating Manual for Economic Development Services Programs,” as may be amended from time to time, containing procedures for fiscal management and accountability.
Operating Manual. Contractor acknowledges receipt of, and shall comply with, the Operating Manual, which is hereby incorporated in full and made a part of this Agreement by this reference, including, but not limited to, those provisions related to fiscal accountability, eligible and ineligible Plan expenditures, and procedures for financial management, accounting, budgeting, record keeping, reporting, and other administrative functions. If Contractor desires any change to the procedures set forth in the Operating Manual, Contractor shall request such change, in writing, and secure the City’s written approval before implementing any such change.

Not later than six (6) months before the projected Substantial Completion Date as set forth on the Project Schedule, Contractor shall submit for Concessionaire’s Approval a draft of the complete equipment and system instructions and procedures for the operation and maintenance of the systems and items of plant and equipment incorporated into the DB Project as part of the DB Work. If Concessionaire does not approve the draft, it shall provide comments thereon to Contractor within thirty (30) days after receipt, and Contractor promptly shall incorporate or otherwise respond to Concessionaire’s comments and submit a revised draft for Concessionaire’s Approval. Such procedure shall be repeated until receipt of Concessionaire’s Approval therefor, and the revised product shall be the “Operating Manual.” Not later than forty-five (45) days before the projected date of Substantial Completion as set forth on the Project Schedule, Contractor shall prepare in individually numbered bound volumes and deliver to Concessionaire ten (10) sets of such approved Operating Manual for the DB Project as well as one (1) set to the Department, and shall also provide each of Concessionaire and the Department the same in an electronic form that may be edited and revised electronically.
Operating Manual. IMED shall be solely responsible for the production, content and adequacy (assuming, for this purpose, that each of the Product and Accessories functions as intended, conforms to its specifications and complies with the warranty provisions contained in Article 11) of any operating manual, instruction or brochure provided to users, customers, clients or the general public in connection with the Product and/or Accessories and IMED shall be solely liable for any liabilities attributable to its negligent drafting of the foregoing to the extent such negligence caused such liabilities. This Article 4.8 shall not limit or otherwise alter any liability DEBIOTECH may have under Article 11 or as otherwise provided in the Agreement.

Operating Manual. Parties shall apply the Operating Manual. It is understood between Parties that the Operating Manual takes into account the possibility of transmission agreements between BBL Company and BBL-Shippers concerning interruptible gas transmission from the UK to the Netherlands. BBL Company has the right to reject a Nomination or a Renomination if this (Re)Nomination is not given according to the Operating Manual.
