MBE/WBE. If applicable, unless waived by Institution in writing, Company must expend at least 25% of the Fee (including all modifications and amendments to it) with one or more certified minority business enterprises (“MBE”) and at least 7% of the Fee (including all modifications and amendment to it) with one or more certified women’s owned business enterprises (“WBE”). The Company will adhere to any and all reporting and other requirements as set forth in the Board's Minority and Women Business Enterprise Contract Participation Plan, including but not limited to the Company’s response to Schedule A of the plan on file with the Office of Procurement Services. The Plan can be found at xxxx://xxx.xxx.xxx/services/Pages/Become-a-Vendor.aspx Failure to comply with this provision constitutes a material breach of this Agreement and may result in termination of the Agreement and other remedies.

MBE/WBE. A minority-owned business (MBE) or a women-owned business (WBE) certified by the State Office of Minority and Women Business Assistance (SOMWBA).
MBE/WBE. Due to the emergency nature of the procurement, the City waives the MBE/WBE requirements for the Agreement pursuant to Art. 5, § 28-64 of the Baltimore City Code. The Contractor will make every good faith effort to subcontract to minority and women’s business enterprises if subcontracting is utilized.
MBE/WBE. In accordance with 1980 P.A. 278, MCL 423.321 at seq; MCL 445.901 et seq, the SUBRECIPIENT, in the performance of this Agreement, shall not enter into a Contract with a subcontractor, manufacturer, or supplier listed in the register maintained by the STATE, Department of Labor, of employers who have been found in contempt of court by a federal court of appeals, on not less than three (3) occasions involving different violations during the preceding seven (7) years, for failure to correct an unfair labor practice, as prohibited by Section 8 of Chapter 372 of the National Labor Relations Act, 29 U.S.C. 158. The AUTHORITY may void this Contract if the name of the SUBRECIPIENT, or the name of a subcontractor, manufacturer, or supplier utilized by the SUBRECIPIENT in the performance of this Contract subsequently appears in the register during the performance period of this Contract.
MBE/WBE. The City has an interest in and policy of encouraging the equitable utilization of Minority-Owned Businesses (MBEs) and Women-Owned Businesses (WBEs). Article 5, Subtitle 28 of the Baltimore City Code (the “City Code”) is incorporated into this Agreement by reference. The updates occur on the internet and can be found at xxxx://xxx.xxxxxxxxxxxxx.xxx/Government/city CharterCodes.aspx. In identifying available City-certified MBEs and WBEs, the Grantee is encouraged to use the MBE/WBE Directory available from the Minority and Women’s Business Opportunity Office, (000) 000-0000. A signed copy of the Grantee’s Commitment to Comply or Waiver, as applicable, is attached hereto as Exhibit F and incorporated herein.
MBE/WBE. The requirements of the Baltimore City Code, Article 5, Subtitle 28 (pertaining to Minority and Women’s Business Enterprise), as amended, are hereby incorporated by reference into this Agreement. If applicable, failure of the Consultant to comply with this subtitle shall constitute a material breach of this Agreement and shall entitle the City to terminate this Agreement immediately upon delivery of written notice of termination to the Consultant. The Consultant will make good faith efforts to utilize minority and women’s business enterprises and maintain records reasonably necessary for monitoring compliance with this subtitle. MBE/WBE. Pursuant to Section 308.01 of the Laws of Westchester County, it is the goal of the County to use its best efforts to encourage, promote and increase the participation of business enterprises owned and controlled by persons of color or women in contracts and projects funded by all departments of the County. Attached hereto and forming a part hereof as Schedule "C" is a questionnaire entitled “Business Enterprises Owned and Controlled by Persons of Color or Women” which the Manager agrees to complete.
MBE/WBE. Due to the emergency nature of the Amendment, the City waives the MBE/WBE requirements for the services provided under this Amendment pursuant to Art. 5, § 28-64 of the Baltimore City Code. The Contractor will make every good faith effort to continue to subcontract to minority and women’s business enterprises if subcontracting is utilized. This Amendment shall be effective upon the date of City Purchasing Agent approval (the “Effective Date”). All other terms and conditions of the Original Agreement, except to the extent amended herein, remain in full force and effect. The Recitals are incorporated herein.
