Common use of Lists of Holders of Securities Clause in Contracts

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Guarantee Trustee with a list, in such form as the Preferred Capital Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("“List of Holders"”) as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Guarantee Trustee by the Guarantor. The Preferred Capital Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred TARGETS Guarantee Trustee with a list, in such form as the Preferred TARGETS Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred TARGETS Guarantee Trustee provided, Trustee; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred TARGETS Guarantee Trustee by the Guarantor. The Preferred TARGETS Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Securities Guarantee Trustee (unless the Preferred Securities Guarantee Trustee is otherwise the registrar of the Preferred Securities) with a list, in such form as the Preferred Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day fourteen (14) days after January 1 and June 30 each record date for payment of each yearDistributions (as defined in the Declaration), and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Securities Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Securities Guarantee Trustee by the Guarantor. The Preferred Securities Guarantee Trustee may destroy any List of Holders previously given to it on upon receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The In the event the Guarantee Trustee is not also acting in the capacity of the Property Trustee under the Trust Agreement, the Guarantor shall provide cause to be provided to the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, the date (i) within one Business Day after January 1 March 15, June 15, September 15 and June 30 of each yearDecember 15, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders caused to have been given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Investment Guarantee Trustee with a list, in such form as the Preferred Investment Guarantee Trustee may reasonably require, of the names and addresses of the Holders Holder(s) of the Preferred Securities Affiliate Debenture ("List of Holders") as of such date, (i) within one (1) Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Investment Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Investment Guarantee Trustee by the Guarantor. The Preferred Investment Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Capital Securities ("List of Holders") as of such date, (i) within one Business Day 10 days after January 1 and June 30 of each yearrecord date, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 10 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, Trustee; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The In the event the Trust Preferred Guarantee Trustee is not also the Securities Registrar, the Guarantor shall provide the Trust Preferred Guarantee Trustee with a list, in such form as the Trust Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, the date (i) within one five (5) Business Day Days after January 1 March 15, June 15, September 15 and June 30 of each yearDecember 15, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Trust Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Trust Preferred Guarantee Trustee by the Guarantor. The Trust Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date), (i) within one Business Day after January 1 and June 30 of each yearyear and current as of such date, and (ii) at any other time time, within 30 days of receipt by the Guarantor of a written request from the Preferred Guarantee Trustee for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it, provided that it may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after July 1 and January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The To the extent the Preferred Securities Trustee shall not also be acting as Property Trustee at the time action is called for under (i) or (ii) below, the Guarantor shall provide the Preferred Guarantee Securities Trustee with (i) within 14 days after January 1 and June 30 of each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. The Preferred Capital Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with (i) within five days after each record date for payment of Distributions, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such record date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders, which List of Holders shall be as of a date no more than 14 days before such List of Holders is given to the Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with (i) semiannually, not later than June 30 and December 31 in each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, containing all the information in the possession or control of the Guarantor, or any of its Paying Agents other than the Preferred Guarantee Trustee, as to the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such datethe preceding June 15 or December 15, (i) within one Business Day after January 1 and June 30 of each yearas the case may be, and (ii) at any such other time times as the Preferred Guarantee Trustee may request in writing, within 30 days of after the receipt by the Guarantor of any such request, a written request for a List list of Holders similar form and content as of a date no not more than 14 15 days before such List of Holders is given prior to the Preferred Guarantee Trustee provided, that the Guarantor shall not be obligated to provide time such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantorlist is furnished. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.; and

(a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities TECONS ("List of Holders") as of such date, (i) within one 1 Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The In the event the Preferred Guarantee Trustee is not also the Transfer Agent, the Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one 1 Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Investment Guarantee Trustee (unless the Investment Guarantee Trustee is otherwise the Security Registrar of the Affiliate Debenture) with a list, in such form as the Preferred Investment Guarantee Trustee may reasonably require, of the names and addresses of the Holders Holder(s) of the Preferred Securities Affiliate Debenture ("List of Holders") as of such date, (i) within one (1) Business Day after January 1 June 15 and June 30 December 15 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Investment Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Investment Guarantee Trustee by the Guarantor. The Preferred Investment Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Securities Trustee with (i) within 14 days after January 1 and June 30 of each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that PROVIDED THAT the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.; and

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Common Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Common Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities (a "List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, year and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders Holders. Such list shall be as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that the Trustee. The Guarantor shall not be obligated to provide such List of Holders if at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide furnish or cause to be furnished to the Preferred Guarantee Trustee with (a) semiannually, not later than [___________] and [_________] in each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each yeara date not more than 15 days prior to the delivery thereof, and (iib) at any such other time times as the Guarantee Trustee may request in writing, within 30 days of after the receipt by the Guarantor of a written request for any such request, a List of Holders as of a date no not more than 14 15 days before such List of Holders is given prior to the Preferred Guarantee Trustee providedtime such list is furnished; provided that, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Common Guarantee Trustee with a list, in such form as the Preferred Common Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Common Securities ("List of Holders") as of such date, date (i) within one Business Day after January 1 and June 30 concurrently with the provision of each yearsuch a list to the Institutional Trustee pursuant to the Declaration, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Common Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Common Guarantee Trustee by the Guarantor. The Preferred Common Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Securities Trustee with (i) within 14 days after January 1 and June 30 of each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.; and

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Trust Preferred Securities ("List of Holders") as of such date, (i) within one Business Day 14 days after January 1 and June 30 each record date for payment of each yearDistributions, as of such record date, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee, provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the GuarantorGuarantor or in the event that the Preferred Guarantee Trustee is the Registrar under the Declaration. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Securities Guarantee Trustee (unless the Preferred Securities Guarantee Trustee is otherwise the registrar of the Preferred Securities) with a list, in such form as the Preferred Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("“List of Holders"”) as of such date, (i) within one Business Day fourteen (14) days after January 1 and June 30 each record date for payment of each yearDistributions (as defined in the Declaration), and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Securities Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Securities Guarantee Trustee by the Guarantor. The Preferred Securities Guarantee Trustee may destroy any List of Holders previously given to it on upon receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Investment Guarantee Trustee with a list, in such form as the Preferred Investment Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities Affiliate Debentures ("List of Holders") as of such date, (i) within one (1) Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Investment Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Investment Guarantee Trustee by the Guarantor. The Preferred Investment Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January June 1 and June 30 December 1 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall, or shall cause the Property Trustee to, provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, list of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day 15 days after January 1 and June 30 each record date for payment of each yearDistributions, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders Holders, as of a date no more than 14 15 days before such List of Holders is given to the Preferred Guarantee Trustee, excluding from any such list the names and addresses received by the Preferred Guarantee Trustee providedin its capacity as registrar for the Preferred Securities, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Securities Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Series B Capital Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 December 15 and June 30 15 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Trust Preferred Guarantee Trustee with a list, in such form as the Trust Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Trust Preferred Securities ("List of Holders") as of such date, (i) within one Business Day fourteen (14) days after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 fourteen (14) days before such List of Holders is given to the Trust Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Trust Preferred Guarantee Trustee by the Guarantor. The Trust Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Guarantee Trustee with a list, in such form as the Preferred Capital Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Capital Securities ("List of Holders") as of such date, (i) within one Business Day after on or before January 1 15 and June 30 July 15 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders Holders, as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Guarantee Trustee by the Guarantor. The Preferred Capital Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after as of January 1 and June 30 of each year, within 20 Business Days thereafter, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request from the Preferred Guarantee Trustee for a List of Holders Holders, which shall be as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide furnish or cause to be furnished to the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) semiannually, within one Business Day after January 15 days before and not later than June 1 and June 30 of December 1 in each year, and (ii) at any such other time times as the Trustee may request in writing, within 30 days of after the receipt by the Guarantor of a written request for any such request, a List of Holders as of a date no not more than 14 15 days before such List of Holders is given prior to the Preferred Guarantee Trustee providedtime such list is furnished; provided that, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the GuarantorGuarantor or at any time the Trustee is the Securities Registrar under the Declaration of Trust. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one ten Business Day Days after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee (unless the Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one three Business Day Days after January 1 May 15 and June 30 November 15 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee, provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Series B Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Series B Capital Securities ("List of Holders") as of such date, (i) within one Business Day fourteen (14) days after January 1 and June 30 each record date for payment of each yearDistributions, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with (i) within 15 days after each record payment date of Distributions, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("“List of Holders"”) as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Preferred Guarantee Trustee providedTrustee, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Capital Securities ("“List of Holders"”) as of such date, (i) within one Business Day 10 days after January 1 and June 30 of each yearrecord date, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 10 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee provided, Trustee; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The To the extent not available to the Trustee, the Guarantor shall provide furnish or cause to be furnished to the Preferred Guarantee Trustee with (a) quarterly, not later than March 15, June 15, September 15 and December 15 in each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, a date not more than 15 days prior to the delivery thereof as required by the Trustee and (iib) at any such other time times as the Trustee may reasonably request in writing, within 30 days of after the receipt by the Guarantor of a written request for any such request, a List of Holders as of a date no not more than 14 15 days before such List of Holders is given prior to the Preferred Guarantee Trustee provided, time such list is furnished; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 concurrently with the provision of each yearsuch a list to the Property Trustee pursuant to the Trust Agreement, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with (i) within 14 days after January 1 and June 30 of each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Capital Securities Guarantee Trustee (unless the Capital Securities Guarantee Trustee is otherwise the registrar of the Capital Securities) with a list, in such form as the Preferred Capital Securities Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 15 and June 30 July 15 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Capital Securities Guarantee Trustee Trustee, provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Capital Securities Guarantee Trustee by the Guarantor. The Preferred Capital Securities Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Partnership Preferred Securities ("List of Holders") as of such date, (i) within one Business Day 1 day after January 1 and June 30 of each year, year and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, Trustee; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Trust Preferred Securities ("List of Holders") as of such date, (i) within one Business Day 14 days after January 1 and June 30 each record date for payment of each yearDistributions, and (ii) at any other time within 30 days of receipt by the Guarantor Trust of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee providedTrustee, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The In the event the Trust Preferred Guarantee Trustee is not also the Securities Registrar, the Guarantor shall provide the Trust Preferred Guarantee Trustee with a list, in such form as the Trust Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("“List of Holders"”) as of such date, the date (i) within one five (5) Business Day Days after January 1 March 15, June 15, September 15 and June 30 of each yearDecember 15, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Trust Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Trust Preferred Guarantee Trustee by the Guarantor. The Trust Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one 1 Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt re- ceipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee (i) on a semi-annual basis, within five Business Days after a record date, with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, ,and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List therefor. Such list of Holders shall be as of a date no more than 14 15 days before such List of Holders list is given to the Preferred Guarantee Trustee provided, that the Trustee. The Guarantor shall not be obligated to provide such List list of Holders if at any time the List of Holders list does not differ from the most recent List of Holders list given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List list of Holders previously given to it on receipt of a new List list of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 and December 31 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 15 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide furnish or cause to be furnished to the Preferred Guarantee Trustee with (a) semiannually, not later than February 15 and August 15 in each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each yeara date not more than 15 days prior to the delivery thereof, and (iib) at any such other time times as the Trustee may request in writing, within 30 days of after the receipt by the Guarantor of a written request for any such request, a List of Holders as of a date no not more than 14 15 days before such List of Holders is given prior to the Preferred Guarantee Trustee provided, time such list is furnished; provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee (unless the Guarantee Trustee is otherwise the registrar of the Series B Capital Securities) with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day 14 days after January 1 and June 30 each record date for payment of each yearDistributions (as defined in the Declaration), and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, however, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on upon receipt of a new List of Holders.

Lists of Holders of Securities. (a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one 14 Business Day Days after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee, provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) The Guarantor shall provide the Preferred Guarantee Securities Trustee with (i) within 14 days after January 1 and July 1 of each year, a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date, (i) within one Business Day after January 1 and June 30 of each year, and (ii) at any other time within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee provided, provided that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor, and (ii) at any other time, within 30 days of receipt by the Guarantor of a written request for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee. The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.; and

(a) The Guarantor shall provide the Preferred Guarantee Trustee with a list, in such form as the Preferred Guarantee Trustee may reasonably require, of the names and addresses of the Holders of the Preferred Securities ("List of Holders") as of such date), (i) within one Business Day after January 1 and June 30 of each yearyear and current as of such date, and (ii) at any other time time, within 30 days of receipt by the Guarantor of a written request from the Preferred Guarantee Trustee for a List of Holders as of a date no more than 14 days before such List of Holders is given to the Preferred Guarantee Trustee Trustee; provided, that the Guarantor shall not be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Preferred Guarantee Trustee by the Guarantor. The Preferred Guarantee Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it, provided that it may destroy any List of Holders previously given to it on receipt of a new List of Holders.. 4

The Preferred Guarantee Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.
