Funding will be reduced for individual schools based on the number of pupils permanently excluded prior to the commencement of this agreement where the Authority has the responsibility to provide education. This will be linked directly to pupils and the cost will be aligned to the cost of placement at the appropriate learning centre as consulted on and agreed through Schools Forum, until the pupils is reintegrated or no longer the responsibility of the Authority to educate. However, each school will receive at least 43% of their total Funding Allocation.

Funding Formula. Settling Funding Parties agree to fund up to $80,000 per Eligible Acre (up to a total payment of $24 million) identified in Funded RD ASAOCs. The Parties intend that funding shall occur as set forth in Paragraphs 18 and 19 of this Agreement and that the disbursement of funds by EPA to Performing Parties will be made as set forth in Paragraph 21 of this Agreement.
Funding Formula. The Public Defender will use the following funding formula to determine the annual amount owed by each municipality. In March of each year, the Public Defender will calculate the percentage of the total number of municipal cases generated by each municipality’s court during the prior calendar year. After determining the total cost of the Municipal Court Attorney for the next fiscal year, the Public Defender will calculate the amount owed by each municipality by multiplying each municipality’s percentage by the total cost. Exhibit A attached to this agreement shows the calculations and amount owed by each municipality for the 2015-2016 fiscal year. The Public Defender will recalculate the percentages in March of each year and will distribute in writing the calculation of the percentages, the total cost, and the cost attributed to each municipality to the Municipalities and the York County Treasurer (the Treasurer) by April 1 each year. The Public Defender will annually distribute the information listed above in substantially the same form as Exhibit A.
