Common use of Equitable Remedy Clause in Contracts

Equitable Remedy. The Parties acknowledge and agree that there may be no adequate remedy at law for any breach of a Party’s obligations under Section 11.02 (GreenLight Warranties and Undertakings) Section 11.01 (Mutual Warranties and Undertakings) or Article 6 (Confidentiality) and, which breaches may result in irreparable harm to the other Party, and therefore, that upon any such breach or any threat thereof, the non-breaching Party will be entitled to seek appropriate equitable relief (without the posting of any bond) in addition to whatever remedies it might have at law.
