Entry Into Commercial Service. 15.1 Commercial Operation Date (COD)
Entry Into Commercial Service. 10.8.1. The construction and development of the Project shall be deemed to be complete when the Completion Certificate is issued under the provisions of Clause 10.7.8 or 10.7.9, and accordingly the Commercial Operation Date (the “COD”) of the Project shall be the date on which such Completion Certificate is issued. The Project shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive the Storage and Handling Charge from the Authority in accordance with the provisions of Article 15.
Entry Into Commercial Service. 15.1. Commercial Operation Date (COD) Project shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”). The Project shall enter into commercial service on COD whereupon the Concessionaire shall have to make the Payment Obligations to the Authority in accordance with the provisions of Article 25.
Entry Into Commercial Service. 15.1 Commercial Operation Date (COD) XXX Ropeway or part thereof shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued] 9 (the “COD”). The XXX Ropeway shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect Fee in accordance with the provisions of Article 28,provided, however, that the entry of XXX Ropeway or part thereof into commercial service shall always be subject to compliance with the provisions of Clause 18.3.
Entry Into Commercial Service. 13.1.1. The rights, privileges, liberties and obligations of the Concessionaire, particularly the Concession shall commence from the date on which all Conditions Precedent have been satisfied in accordance with Article 4 (the "Appointed Date"), and determination of the Appointed Date by the Contracting Authority shall be final, conclusive and binding on the Concessionaire. The Project Highway shall for the purposes of this Agreement enter into commercial service on the Appointed Date whereupon the Concessionaire shall be entitled to demand and collect Fee and perform its O&M Obligations subject to and in accordance with the provisions of this Agreement.
Entry Into Commercial Service. 15.1 Commercial Operation Date (COD) Eight-Laning shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the "COD"). The Project Road shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect Fee in accordance with the provisions of Article 27.

The commercial operation date of the Project shall be the Appointed date (the “COD”). The Project Highway shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect Fee in accordance with the provisions of Article 27.

Commercial Operation Date (COD) Storage Facility shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”). The Storage Facility shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive Storage and Handling Charges from the Authority in accordance with the provisions of Article 25. For avoidance of all doubt it is, hereby, agreed and accepted by the Parties that the declaration of COD, in case of earlier completion of the Storage Facility and issue of Completion Certificate as detailed in Clause 14.2, will be at the sole and exclusive discretion of the Authority. Damages for delay Subject to the provisions of Clause 12.3, if COD does not occur prior to the 91st (ninety first) day after the Scheduled Completion Date, unless the delay is on account of reasons solely attributable to the Authority or due to Force Majeure, the Concessionaire shall pay Damages to the Authority in a sum calculated at the rate of 0.1% (zero point one per cent) of the amount of Performance Security for delay of each day until COD is achieved.
Entry Into Commercial Service. 15.1 Commercial Operation Date (COD) Commissioning of Haji Bunder (Sewree) to Elephanta Island Ropeway shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14 and in accordance with the format provided in Schedule K. hereunder The Haji Bunder (Sewree) to Elephanta Island Ropeway shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to demand and collect Fee in accordance with the provisions of Article 25. Concessionaire may initiate Commercial activity only after the commissioning operation of Ropeways. No commercial activity shall start before COD of the ropeway project. Thus, only after ropeway starts functioning shall other commercial activities be permitted to be taken up.
