Entry Into Commercial Service. 10.8.1. The construction and development of the Project shall be deemed to be complete when the Completion Certificate is issued under the provisions of Clause 10.7.8 or 10.7.9, and accordingly the Commercial Operation Date (the “COD”) of the Project shall be the date on which such Completion Certificate is issued. The Project shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive the Storage and Handling Charge from the Authority in accordance with the provisions of Article 15.

Entry Into Commercial Service. Commercial Operation Date (COD) Storage Facility shall be deemed to be complete when the Completion Certificate or the Provisional Certificate, as the case may be, is issued under the provisions of Article 14, and accordingly the commercial operation date of the Project shall be the date on which such Completion Certificate or the Provisional Certificate is issued (the “COD”). The Storage Facility shall enter into commercial service on COD whereupon the Concessionaire shall be entitled to receive Storage and Handling Charges from the Authority in accordance with the provisions of Article 25. For avoidance of all doubt it is, hereby, agreed and accepted by the Parties that the declaration of COD, in case of earlier completion of the Storage Facility and issue of Completion Certificate as detailed in Clause 14.2, will be at the sole and exclusive discretion of the Authority. Damages for delay Subject to the provisions of Clause 12.3, if COD does not occur prior to the 91st (ninety first) day after the Scheduled Completion Date, unless the delay is on account of reasons solely attributable to the Authority or due to Force Majeure, the Concessionaire shall pay Damages to the Authority in a sum calculated at the rate of 0.1% (zero point one per cent) of the amount of Performance Security for delay of each day until COD is achieved.

Concessionaire may initiate Commercial activity only after the commissioning operation of Ropeways. No commercial activity shall start before COD of the ropeway project. Thus, only after ropeway starts functioning shall other commercial activities be permitted to be taken up.
