Common use of Deed of Trust Clause in Contracts

Deed of Trust. The term "Deed of Trust" shall mean the Indemnity Deed of Trust, Security Agreement and Assignment of Leases and Rents executed of even date herewith granted by the Land Owner to trustees for the benefit of the Bank, creating first priority a lien and security interest in the Real Property as security for the Land Owner's Guaranty.
