Concerning the Collateral Agent. Deutsche Bank Trust Company Americas, in executing and acting under this Agreement, is acting solely in its capacity as Collateral Agent under the Indenture, and in acting hereunder, shall be entitled to all of the rights, privileges, protections, indemnities and immunities accorded to the Collateral Agent under the Indenture, as if fully set forth herein.
